SERVICE RULES (SALIENT POINTS)

TERMS AND CONDITIONS OF SERVICE OF EMPLOYEES

SALIENT POINTS:

A) SCOPE AND DEFINITION :

1. These service rules shall come into effect from 12th FEBRUARY 1995 and he applicable to all the employees of this institution.
2. Conditions which are not mentioned in the individual contract or employment letter but which are mentioned here in shall be automatically applicable to all the employees.
3. As situations and circumstances change, these rules and conditions of service may be suitably amended and modified by the AADHUNIK EDUCATION SOCIETY. Such amendments shall become binding on all employees.
4. In case of any confusion or conflict in the interpretation of these service rules, the interpretation of society shall be final and binding.
5. Managing committee means, the committee of persons which is immediately responsible for the management of the school and which is called hereafter the managing committee.

OTHER DEFINITIONS OF VARIOUS TERMS ARE IN MAIN SERVICE RULES AS DEFINED BY CBSE.

B) QUALIFICATION OF TEACHING STAFF:

1. Minimum qualification required for teaching staff for appointment in the High School shall be B.A. / B.Sc. / B.Com with B.Ed.
2. Minimum qualification required for teaching staff for appointment for Senior Secondary classes is as per rule 53 of CBSE Affiliation Bye-Laws.
3. The minimum qualification required for a teaching staff for appointment in the middle /primary section shall be matriculation or equivalent with T.T.C., J.B.T. , Nursery teacher's training or Montessori.
4. As per NCTE under RTE Act 2009 passing of TET is essential qualification to be eligible for appointment as teachers of Classes I to VIII.
5. CTET/TET compulsory for all teaching staff.
6. As per RTE Act (Amendment Bill) 2017 B.El.Ed (Bachelor of Elementary Education) or Diploma in Elementary Education (D.El.Ed) is essential for teaching staff of Class I to VIII. Also please refer NIOS website.

C) APPOINTMENT, TERMINATION & RETIREMENT:

1. Appointments of all categories are made by the Aadhunik Education Society or the Managing Committee either by direct recruitment or by promotion and in accordance with and upon such conditions as the Aadhunik Education Society may decide.
2. All appointment will be contractual ranging from one to five years at the discretion of the management.
3. All contracts will be subject to renewals depending on the performances.
4. All staff other than those appointed on temporary/contractual basis, will be appointed in the first instance on probation for a period of 2 Years. This period may be extended by the appointing authority. During or at the expiry of the said period of probation or the extended period of probation, the A.E. Society / Managing Committee shall have the right to terminate your services without any notice or without assigning any reason.
5. On satisfactory completion of the probation , the employee shall he informed in writing of his/her confirmation and of the benefits that accrue from confirmation.
6. The appointment of a probationary / temporary / contractual staff may be terminated by either party by giving one month's notice or on payment of one month's pay in lieu of notice with the provision however the term of a temporary / contractual staff will come to an end automatically when the specific work for which he/she was employed is completed or when the period for which he/she was in the first instance employed ends. Neither party will be required to give any reasons for such termination.
7. On appointment of the staff except for class IV employee one month's salary shall be kept as security which will be refunded on termination of employment Subject to Clause C. 4 above.
8. After confirmation , your services shall be liable to be terminated on one month's notice or salary in lieu thereof except on disciplinary grounds in which case no such notice or payment in lieu thereof shall be necessary.
9. Even after confirmation, if you are found absent from duty for more than three days without obtaining prior permission in writing of the A.E. Society / Managing Committee / Principal or if you proceed on leave without obtaining prior permission or overstay the sanctioned leave for more than three days without first getting it sanctioned then your services shall be liable to be terminated on disciplinary grounds without any further reference/notice to you (Clause C . 6)
10. Every staff shall retire from service on attaining the age of 60. The Aadhunik Education Society or the Managing Committee may grant extension for a period not exceeding two years if staff is National Teacher awardee subject to meritorious service, impeccable character, sound health, good leadership, management qualities and outstanding results throughout with prior approval of the CBSE.
11. A teacher may relinquish his/her services by giving one month notice in writing or paying a sum equal to one pay in lieu of the notice.
12. Appointment and continuance in the employment in the school will be subjective to being found medically fit and the A.E.Society / Managing Commillee/Principal shall have the right to get you examined or re-examined by the school physician/Doctor or registered medical practitioner, whose finding will be final and binding upon you.
13 .In case of any change in the address during the course of your employment in the school, it shall be the employee's duty to intimate such change in writing to the Manager / Principal within one week from the date of such change.
14. Termination of Service Due to Abolition of Posts etc.
1. If an employee at any time after confirmation intends to resign he/she shall give three months’ notice in writing or three months’ salary including all allowances to the School.
2. The Managing Committee/Society shall also be competent to terminate the services of a confirmed employee only in case of abolition of a post due to closing down of school / class or reduction in the number of sections of a class or discontinuance of a teaching subject .
3. The Managing Committee/Society shall have the power to relax the period of notice or payment of salary in special circumstances.

D) PAY

1. The scale of pay and other allowances shall be the one fixed by Aadhunik Education Society and shall be subject to modification from time to time.
2. The salary of the staff shall be paid during the first week of every following month, after signing a stamped receipt.
3. Salaries shall be paid to the staff without any deduction except the following
(a) Deduction for contribution to the provident fund (when applicable)
(b) Deduction for absence from duty.
(c) Deduction for damage to or loss of goods entrusted to the staff, and loss of money which he/she is required to account for, if the loss or damage is directly attributed to his/her neglect or fault.
4. The annual increment as shown in the pay scale shall not be claimed by you as a matter of right but will depend upon the maintenance of high standard of discipline, good work, efficiency, integrity, punctuality and regularity.

E) PROVIDENT FUND , GRATUITY AND OTHER BENEFITS :

1. Provident fund facilities shall become available to the teaching and non-teaching staff asper Govt. Rules. The school shall contribute equal amount. The provident fund of the teaching and non-teaching staff will be governed by the provisions of the provident fund act.
2. Confirmed teaching and non-teaching staff shall become entitled to gratuity in the following manners:-
(a) After rendering continuous services of not less than ten years.
(b) On retirement after attaining the superannuation age provided that at time of retirement, he/she must have put in ten years of continuous service.
(c) On resignation provided that at the time of resignation, he/she must have put in ten years of continuous service.
(d) Ten year period shall be calculated for a teaching and non-teaching staff from the date of confirmation (after completion of probationary period).
(e) Notwithstanding the provisions in the foregoing gratuity clauses , gratuity shall be paid to teaching or non-teaching staff or their legal heir on death or disablement due to accident or disease as the case maybe.
3. The gratuity shall be calculated at the rate of fifty percent (50%) of the last drawn basic into the number of years served but not exceeding Rs 50,000/-.
4. The teaching or non-teaching staff shall forfeit the facilities of gratuity if he/she is dismissed or discharge from the services on any disciplinary grounds.
5. Teaching or non-teaching staff working on probation / adhoc / temporary /contract basis his/her period of working shall not be included in calculating the period of ten years.
